In November my sister filed for divorce from her husband and removed him from HER checking account. The very next day he goes to a payday loan store and gives them a check from my sisters account (both their names were on the check) even though he technically was no longer on the account. They got divorced in January and in the divorce decree she knew about 1 OTHER payday loan he took out and the decree specifically states that he needs to pay that (but it doesnt mention this loan because he never disclosed it). Now in July without her even knowing about the case she is getting a wage garnishment for this 00 loan she never knew about. Is she liable because they were still married when he took the loan out? He's now out of state and joined the Army but they went after her instead. He's already 6 months behind on child support, my sister cant survive with 2 kids and no help. He hasn't even paid the cash he was court ordered to pay in the divorce decree. The case is in Clark County, Nevada What should she do? Can she do this without getting a lawyer (since she can't afford one)?

And, even though she's divorced, she should be able to shop at the commissary and PX on behalf of the kids. However, an interesting fact is that he is now in the Army. An allotment can be set up for her. Also, she needs to ensure the kids are being covered by his military benefits, especially health care. I was a legal clerk in the Army back in the 1970's and I can tell you that the Army will not put up with a soldier who has unpaid debts, especially if they involve child support. Alternatively, she can contact his commander. If he continues with his indebtedness, the Army will discharge him payday loans in one hour in canada She needs a lawyer to sort out the payday loan issue. She needs to contact the Judge Advocate General's office on the post where he's assigned and let them know what's going on.

Tell her to go back to court and ask the judge to demand the ex to pay HER back for the wage garnishment. Or to have the judge declare that the loan is his not hers payday loans in one hour in canada

easy to do. But State to State, the laws vary. If she can't afford a lawyer, she is entitle to counsel( free). ( and ask for a court appointed attorney). She should file a "small claims" action against the company trying to garnish her wages. I'm afraid she may be liable for that loan. tell her to go to court and file( in layman's terms) on her own. She better jump on it though if they're already talking "Garnish" payday loans in one hour in canada
